In the State of Florida premise liability can be a confusing concept for those without legal experience and skill, as it can be very complicated in terms of which parties are valid plaintiffs and which parties would be proper defendants.

Below is an overview of the Standards for Premise Liability: Standards for Premises Liability

  • Invitee – An invitee is owed the following standard of care from those who manage the property in question: To remove a risk of unreasonable harm; and to exercise ordinary care and to remove any dangerous condition that would reasonably be discovered with basic oversight.
  • Licensee – A licensee is someone who is typically a social guest, and he or she must be protected in the following ways:
  • To be free of dangerous conditions that the owner knew about or should have known about;
  • To assume that the property possessor exercise ordinary care in keeping the property safe; and
  • To be protected from a dangerous condition that the licensee did not know about or could not have known about under ordinary circumstances.
  • Trespasser – A trespasser is someone who is on the property without permission, either express or implied. If the possessor of the property did not know about the trespassers, then he or she owes the entrants no duty of care. If he or she did know about them, it’s possible that the possessor would be required to remove dangerous conditions, but this is a matter of fact that is typically decided by a jury.

As you see, the concepts surrounding premise liability are quite technical in nature and involve both matters of law and fact that need to be proven. If you’ve been injured on someone else’s property, you will need the help of a premise liability lawyer to make sure that your rights are properly protected and enforced.
