Do I have a Florida Medical Malpractice Case?

Ask yourself: Was I injured, or was a loved one killed, because of an error by a medical provider? If yes, contact us today.

When a personal injury situation arises, the defendant’s actions are compared to what a reasonable person in a similar situation would have done. If the defendant’s actions do not meet that standard, he or she is likely going to be found responsible for the injuries that resulted. Likewise, medical professionals are also scrutinized in medical malpractice cases.

What are the types or causes of medical malpractice cases?
In the State of Florida, there are generally two types of errors that fall under medical malpractice.

I. Errors of Commission which include the following:

  • Misdiagnosis that can result in wrong diagnosis or treatment
  • Blood screening errors
  • Contaminated blood / donor blood testing error
  •  Drug Errors including:
    • Wrong drug administered, contraindicated drug given
    • Wrong drug given (drug name confusion - many are very similar)
    • Wrong choice of administration site (intravenous, intramuscular)
    • Wrong dosage given (too much, too little possible overdose)
    • Wrong rate of administration
    • Wrong patient (you were given someone else's drugs)
    • Bad Drugs given (drug subsequently banned by the FDA)
    • Surgical Errors including:
      • Instruments, clamps, sponge, or other device left inside patient
      • Post-surgery infections
      • Unnecessary operations, surgery and/or procedure
      • Wrong site wrong body part or organ, left or right confused
      • Wrong patient

II. Errors of Omission which include the following:

    • Failed to treat a condition or disease
    • Critical drug not given
    • Critical procedure not performed
    • Inadequate screening
    • Wrong blood type, possible bad transfusion
    • Inadequate donor blood testing
    • Blood contaminated by HIV, hepatitis, etc.

Proving either type of medical malpractice is often costly and requires a prolonged battle with the health care professional, the hospital and the insurance company. Few law firms understand the intricacies of Florida medical malpractice law and fewer still have the experience and resources to successfully pursue justice. Many of our cases come from other law firms who recognize our capabilities and experience in this area of law.
